Welcome to the Italian Plastic website (the “Site”). By accessing or using the Site, you agree to comply with and be bound by the following Terms of Use. If you do not agree to these terms, please refrain from using the Site.

ACCEPTANCE OF TERMS
By using this Site, you signify your acceptance of these terms and conditions. Italian Plastic reserves the right to modify, update, or amend these Terms of Use at any time without prior notice. Your continued use of the Site following the posting of any changes signifies your acceptance of those changes.

AGE RESTRICTION
Access to this Site is restricted to individuals 18 years of age or older. By using this Site, you confirm that you are of legal drinking age in your country or state of residence. If you are not, please exit the Site immediately.

INTELLECTUAL PROPERTY
All content on this Site, including but not limited to text, images, graphics, logos, and software, is the property of Italian Plastic or its content suppliers and is protected by Australian and international copyright laws. You may not use, reproduce, modify, or distribute any content from this Site without express written permission from Italian Plastic.

USE OF THE SITE
You may use the Site for personal, non-commercial purposes only. You agree not to engage in any activity that may:

• Disrupt or interfere with the functioning of the Site.
• Violate any applicable local, state, national, or international laws.
• Infringe upon the rights of others, including their intellectual property and privacy rights.

PRODUCT INFORMATION
Italian Plastic endeavours to ensure that the information on the Site is accurate and up-to-date. However, we make no warranties or representations as to the accuracy, completeness, or reliability of any information, including product descriptions, pricing, or availability. Prices and availability of products are subject to change without notice.

PURCHASING AND SHIPPING
All purchases made through the Site are subject to our Terms and Conditions of Sale. By placing an order, you agree to be bound by those terms. Italian Plastic complies with all relevant Australian alcohol sale and distribution regulations. All sales are final, and Italian Plastic reserves the right to refuse or cancel any order at its discretion.

Italian Plastic reserves the right to end promotions at any time. Coupon codes cannot be added retrospectively or after order processing. Coupons mistakenly not applied at checkout may be issued as a store credit at Italian Plastic's discretion.

In order to guarantee the safe delivery of our wines, Italian Plastic has implemented an extreme weather delivery policy. If extreme weather conditions are present either at our warehouse or at the wine's final destination, we will not ship the wine. In such cases, we will contact the customer to arrange a suitable delivery time when the wine will not be at risk.

Italian Plastic will not deliver to any area deemed a dry zone under Australian law. Please do not attempt to order to these areas as they will be refused.

Due to Liquor Licensing laws, we are currently unable to sell internationally. Orders can only be shipped within Australia.

RETURNS
All refunds will be transacted within 30 days of Italian Plastic being notified and confirmation that the wine has been returned in saleable condition. If you’re returning an item that was discounted or bundled, you will not receive the total price of that individual item. Instead, the refund amount will be adjusted accordingly.

An order may be adjusted or cancelled at the discretion of the Italian Plastic team if reasonable notice is given prior to dispatch. Once the wine is dispatched, it may be recalled or redirected by the customer or upon request to Italian Plastic to act on the customer's behalf. No refunds or credits can be given until the warehouse receives the original wine. If Italian Plastic has been notified of a breakage in transit by our carrier, we will endeavour to send out a replacement to the customer as soon as possible.

We will replace or refund you for any bottle of wine that is received damaged or faulty. We ask the customer to return the unfinished portion of the original bottle for replacement. By law, we cannot accept returns of alcoholic beverages unless the product is corked or damaged. We are also unable to accept returns of wines that were damaged due to adverse weather conditions during shipment or wine that was ordered in error.

Once the wine is received back at the warehouse, we will refund your credit card account for the cost of the wine, less shipping and handling. If the original shipment was damaged or flawed, you will receive a full refund, including shipping and handling charges.

PRIVACY POLICY
Your use of the Site is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using the Site, you consent to the collection and use of your information as described in the Privacy Policy.

LINKS TO THIRD-PARTY SITES
This Site may contain links to third-party websites that are not owned or controlled by Italian Plastic. We are not responsible for the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that Italian Plastic shall not be liable for any damage or loss caused by your use of any third-party site.

LIMITATION OF LIABILITY
To the fullest extent permitted by law, Italian Plastic and its affiliates, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or related to your use or inability to use the Site, even if we have been advised of the possibility of such damages.

GOVERNING LAW
These Terms of Use are governed by and construed in accordance with the laws of the state of South Australia, Australia. You agree to submit to the exclusive jurisdiction of the courts in South Australia or the resolution of any disputes arising from these Terms of Use or your use of the Site.

TERMINATION
Italian Plastic reserves the right, in its sole discretion, to terminate your access to the Site at any time without notice for conduct that we believe violates these Terms of Use or is otherwise harmful to the interests of Italian Plastic or other users.

RISING X ITALIAN PLASTIC TICKET GIVEAWAY

1. Entry Eligibility
   The giveaway is open to Australian residents aged 18 years or older only.

2. Entry Period
   The giveaway opens on Friday, 30 May 2025 and closes at 5:00 pm (AEST) on Wednesday, 4 June 2025 at 12:00 pm (AEST). Entries received after this time will not be considered.

3. How to Enter
   To enter, participants must follow @italianplasticwine on Instagram, tag a friend in the comments of the giveaway post, and like and save the giveaway post. Each comment tagging a different friend counts as one (1) entry. Multiple entries are permitted. The participant must be following the account at the time of the draw to be eligible.

4. Prize
   The prize consists of two (2) tickets to Mount Kimbie at RISING Festival, held in Melbourne, Victoria on Thursday, 5 June 2025, plus a $300 voucher to spend online at italian-plastic.com.au. The total prize value is $478 per winner. The prize does not include travel, accommodation, or any other incidental expenses.

5. Winner Selection
   The winner will be selected at random from eligible entries received during the entry period. The draw will take place on Wednesday, 4 June 2025 at 12:00 pm (AEST). The winner will be notified via social media DM within 1 business day of the draw.

6. Claiming the Prize
   The winner must respond to claim the prize by Wednesday, 4 June 2025 at 6:00 pm (AEST). Failure to respond within this time will result in forfeiture of the prize and selection of an alternative winner.

7. Age Verification
   The winner must provide valid proof of age (e.g., a scan or photo of government-issued ID) via email or secure upload before the prize is issued. If the winner is found to be under 18 or fails to provide valid ID within 72 hours of request, the prize will be forfeited and a new winner will be selected.

8. General Conditions

• The prize is non-transferable and cannot be exchanged for cash or other goods or services.

• The promoter reserves the right to substitute the prize for an alternative of equal or greater value if necessary.

• The promoter’s decision is final, and no correspondence will be entered into.

• Entry into the giveaway constitutes acceptance of these terms and conditions.

9. Privacy
   Personal information collected for the purpose of this giveaway will be used only for administering the competition and contacting the winner. Information will not be shared with third parties except as required by law.
